Legislative Update Week Ending April 10 2015
As we have written recently, Grassley's main problem in getting his bill passed in the Senate is opposition from his fellow Republicans. Grassley said he needs at least 25 Republican co-sponsors to get his bill (S. 2543) to the floor of the Senate for a vote. Have you heard anything about congress fixing a Social Security cut for those of us born in 1960? — K.S. .We want to begin this week's update by reminding you to seriously consider seeing your health care provider if you have been putting it off because of the pandemic. That is especially true if you have a serious health condition and you need treatment or close monitoring. .There are, however, a number of ways that unauthorized workers can, and do, become entitled to benefits based on illegal work (see our "FAHow "Undocumented" Workers Are Becoming Entitled To Social Security" from the May 2012, Volume 17, Number 4 issue of The Social Security & Medicare Advisor. Despite a 2004 law forbidding illegals from claiming Social Security benefits, they are able to do so if at some point their status changes and they receive work authorization — as would happen under an amnesty. With work authorization, noncitizens can file a claim for Social Security benefits. Under current law when determining entitlement for benefits, Social Security uses all earnings for calculating the primary benefit amount, even if the earnings were for unauthorized work using fraudulent documents. All the individual needs to do is to supply evidence of the earnings, such as old W2s, and earnings in the ESF file would be "reinstated" to the account of the claimant. … Continued
The Social Security Administration is required to withhold in benefits for each you earned above the limit until the year in which you reach full retirement age. The year in which you reach full retirement age, you are allowed to earn more. The amount you may earn is adjusted annually. In 2007 when you retired, it was ,960 (,080 per month) for retirees like you who were under full retirement age. .This week, lawmakers remained in their home states and districts for the two-week spring recess. .The term "Notch" refers to the disparity in Social Security benefits paid to people born from 1917 through 1926 and those paid to people born before and after them with similar work/earnings records. Many of those born during the Notch period feel they have not been treated fairly and are not receiving the benefits that Congress intended. On the other hand, the Social Security Administration (SSA), some government officials, and the AARP (formerly the American Association of Retired Persons) say that those born during the Notch period are treated fairly and receiving the benefits that Congress intended. The SSA and the AARP say that Social Security does not promise a specific amount of benefits, rather Social Security is designed to replace a certain percentage of pre-retirement earnings. Who is correct? .TSCL will continue to keep the pressure up on Congress to get this problem solved as soon as possible. .TSCL is gearing up to fight legislation that would cut the current rate of COLA growth. "People who depend on Social Security need a COLA that more adequately protects the buying power of their benefits," says Hyland. TSCL believes seniors would receive higher and more adequate benefits by using an index that more closely tracks senior spending, like the Consumer Price Index for the Elderly (CPI-E). Recently, we announced our support for two pieces of legislation that we believe are long overdue. One bill (S. 499 / H.R. 918) would prevent beneficiaries from collecting both unemployment benefits and disability insurance benefits at the same time.
